Overview

This website is operated by Shimon Nachmani, doing business as Outbound Outdoor ("Outbound Outdoor," "we," "us," or "our"). Our mailing address is 33 Rimon St., Bnei Dror, Israel. By visiting outboundoutdoor.com or buying from us, you agree to these Terms of Service ("Terms"), together with our Privacy Policy, Shipping Policy, and Refund Policy, which are part of these Terms. If you do not agree, please do not use the site.

1. Eligibility and Use of the Site

You must be at least the age of majority in your state or country of residence to place an order. You may not use our site or products for any unlawful or unauthorized purpose.

2. Products and Descriptions

We work to show product colors, images, and specifications accurately. Minor variations can occur because of screen settings, manufacturer updates, or batch differences. We do not warrant that descriptions or other content are error-free. If a product is not as described, your remedy is set out in our Refund Policy.

3. Pricing and Availability

Prices are shown in US dollars and may change without notice. We may limit quantities, discontinue products, or refuse or cancel orders, including orders that appear to be placed by resellers or that involve suspected fraud or pricing errors. If we cancel an order after you have paid, we will refund you in full.

4. Orders and Payment

Payments are processed securely by our payment providers (for example PayPal and Shopify Payments). You agree to provide current, complete, and accurate purchase information. An order confirmation email does not mean we have accepted your order; we accept it when we dispatch the item.

5. Shipping, Returns, and Refunds

Delivery times, duties and taxes, returns, and refunds are governed by our Shipping Policy and Refund Policy.

6. Safe Use of Outdoor Products and Assumption of Risk

Outdoor products such as stoves, grills, fuel appliances, batteries, lanterns, heated or electrical items, tents, and hammocks must be used according to the manufacturer's instructions and all local laws and fire restrictions. Never use combustion appliances inside tents or enclosed spaces. Check hammocks, straps, and anchor points before each use and respect stated weight limits. Camping and outdoor recreation carry inherent risks, including injury, fire, and weather. You are responsible for choosing products that fit your intended use and for using them safely. To the fullest extent permitted by law, you assume the risks that come from using products outside their intended purpose or in disregard of their instructions.

7. Intellectual Property

All content on this site, including the Outbound Outdoor name, logo, text, images, and design, belongs to us or our licensors and is protected by law. You may not copy, reproduce, or use it for commercial purposes without our written permission.

8. Reviews, Feedback, and Submissions

If you send us feedback, reviews, photos, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display it in connection with our business. You agree that your submissions will not be unlawful, abusive, misleading, or infringe anyone's rights.

9. Third-Party Links and Tools

Our site may link to third-party websites or tools. We do not control them and are not responsible for their content, products, or practices.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." EXCEPT FOR ANY WARRANTY THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some states do not allow certain disclaimers, so some of the above may not apply to you.

11. Limitation of Liability and Indemnification

TO THE FULLEST EXTENT PERMITTED BY LAW, OUTBOUND OUTDOOR AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT GAVE RISE TO THE CLAIM. Nothing in these Terms limits liability that cannot be limited by law, and some states do not allow these limitations, so they may not fully apply to you.

You agree to indemnify and hold harmless Outbound Outdoor from claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of a product, or your violation of any law or third-party right.

12. Dispute Resolution; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

12.1 Informal resolution first. Before starting any formal proceeding, you agree to contact us at support@outboundoutdoor.com with a written description of the problem and what you are asking for. We will try in good faith to resolve it within 30 days.

12.2 Binding arbitration. If we cannot resolve a dispute informally, you and Outbound Outdoor agree that any dispute, claim, or controversy arising out of or relating to these Terms, the site, or any product you buy (a "Dispute") will be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at adr.org. The arbitration may be conducted by video, phone, or written submissions, or in person in your county of residence if you request it. The arbitrator may award the same individual relief a court could, and the Federal Arbitration Act governs this Section.

12.3 Exceptions. Either party may (a) bring an individual claim in small claims court if it qualifies, or (b) seek injunctive relief in court for infringement or misuse of intellectual property.

12.4 Class action waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND OUTBOUND OUTDOOR AGREE THAT EACH MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of more than one person. If this class waiver is found unenforceable as to a claim, that claim must be brought in court (not arbitration), in accordance with Section 13.

12.5 30-day right to opt out. You may opt out of arbitration and the class action waiver by emailing support@outboundoutdoor.com within 30 days of your first order or first use of the site, whichever is earlier. Your email must include your name, the email address used for your order, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

12.6 Fees. Arbitration fees are allocated under the AAA Consumer Arbitration Rules. We will pay any filing, administrative, and arbitrator fees beyond what you would pay to file in court, where required by those rules or by law.

12.7 Survival. This Section survives termination of your relationship with us.

13. Governing Law and Venue

These Terms and any Dispute are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, and by the Federal Arbitration Act. Any Dispute that is not subject to arbitration will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. This Section does not take away mandatory consumer protection rights you have under the laws of your state of residence.

14. Changes to These Terms

We may update these Terms by posting the revised version on this page with a new "Last updated" date. Changes apply to orders placed after they are posted. Continued use of the site after changes are posted means you accept them. Changes to Section 12 do not apply to Disputes already pending.

15. Severability and Entire Agreement

If any provision is found unenforceable, the rest of these Terms remain in effect. These Terms, with our Privacy, Shipping, and Refund Policies, are the entire agreement between you and us about your use of the site and purchases.
